THE INFORMATION WE COLLECT

Personal Information may include:
• Personal identifiers and record information. For example:
◦ Username and password associated with your User Account, User Account age, and social media account;
◦ Name, alias, physical address (current and former), email address (personal and work-related), telephone number, date of birth, medical condition, and any other personal profile or account information you affirmatively provide to us;
◦ IP address, device ID, online identifiers, and other information collected via cookies, pixels or other software when you access the Site;
◦ Status as a victim of domestic violence, assault, or stalking (e.g., if we are provided with a copy of a restraining order limiting a third party’s access to a property);
◦ Application and claims history, criminal history, and criminal records (e.g., as part of our standard background checks for applicants or if we are provided with a copy of a restraining order/related documentation limiting a third party’s access to a property);
◦ Emergency contact information, children’s names, parent’s name(s) (e.g., if included on your application, if you volunteer this information, and/or if we are provided with a copy of a restraining order/related documentation limiting a third party’s access to a property);
◦ Insurance policy information, including insurance policy number;
◦ Identifying numbers such as Social Security, Driver’s License, passport or other state or national identification card numbers and details; and
◦ Protected classifications such as AIDS/HIV status, citizenship status, disability or specific condition, gender identity and gender expression, marital status, military or veteran status, political affiliation and activities, racial or ethnic origin, religion and religious beliefs, reproductive health data, and sexual orientation (e.g., if your application or lease lists two individuals of the same gender as spouses, if included or necessary as part of an accommodation request, if provided or requested in determining eligibility for certain grants or funds, etc.);
• Biometric identifiers such as health data and voice recordings;
• Sensory information such as audio information (i.e., voicemails) and visual information (i.e., videos);
• Geolocation information;
• Internet usage information such as interactions with advertisements and the Site, Site navigation and interaction history, and interactions with applications;
• Financial information such as credit card, debit card or bank account number, credit report information, credit history, bank statements, and income;
• Commercial information including purchasing tendencies, personal property records, records of products or services considered or purchased;
• Payment information, including information submitted in connection with online transactions;
• Professional or employment information such as benefits and entitlements data, bonus payments, bullying and harassment details, business unit / division, company / entity, end date and reason for termination, hours of work, job title / role, office location, previous work history, start date, compensation data, grievances and complaints, health & safety related information and reporting, personnel number, record of absence / time tracking / annual leave, reference or background checks, salary, wage, salary / wage expectation, and workers compensation claims;
• Educational information, including education and training history;
• Other information that you voluntarily provide such as any content or contributions you post on the Site (e.g., photos or comments on any forums); any information you provide in communications with us, such as via email or in residential service requests, including move-in date;
• Any information you provide in communications with us, such as via email or in residential service requests, including move-in date;
• Inference information including abilities, preferences, behavior, and attitudes; or
• Sensitive personal information including sensitive identification numbers such as Social Security or Driver’s License numbers, gender, disability or health information, racial information, sexual orientation, or information that can be surmised from information that you provide us (e.g., based on the genders of co-tenants).
In addition to collecting Personal Information, we may collect information that does not identify you and is not associated with your Personal Information. We also may de-identify information so it no longer identifies you. We aggregate and use such information to engage in marketing and other activities as well as for internal business reporting and reviews. Because this information is no longer Personal Information, it is outside the scope of this Privacy Policy.
HOW WE MAY USE PERSONAL INFORMATION
We may use the above categories of Personal Information as permitted by law, including for the following business purposes:
• To provide Services to you. For example:
◦ for you to access certain features on our Site (e.g., to submit an application or use online resident services), we may request that you create a login name and password (a “User Account”);

• As required or allowed by law or for the protection of individuals or the public, e.g., in response to a legal demand, court order, subpoena or similar process, if we are otherwise required to do so by law, or we in good faith believe that such action is reasonable in order to (a) comply with the law or with legal process (including utilization and/or verification of federal, state, or locally provided governmental housing vouchers and/or residential assistance funds), (b) protect and defend our rights and property, (c) protect against misuse or unauthorized use of the Site, or (d) protect the personal safety or property of our users or the public. Please note that we may not provide you with notice prior to use or disclosure in such cases;
• For internal purposes, such as development of new products, performance reviews, reviews of properties, business planning, customer service, account maintenance, etc.;

• To conduct background checks and for other purposes in the ordinary course of providing residential and leasing services and processing applications;

• to our third-party service providers who provide services such as website hosting, data analysis, background checks, renters insurance, payment processing, order fulfillment, infrastructure provision, IT services, customer service, maintenance requests, email delivery services, physical delivery services and management, credit card processing, auditing services, collection services, and other services, to enable them to provide services;

Texas residents have a right to opt-out of the sale and/or targeted advertising or certain “profiling” uses of their Personal Information. MAA does not, however, sell Personal Information, so certain aspects of this right may not be relevant to Personal Information we may have about you. In Texas, MAA does not process or use Personal Information for the purposes of targeted advertising (generally, this means displaying an advertisement to you that is selected based on Personal Information that we obtained from your activities over time and across nonaffiliated websites or online applications) or “profiling” (generally, this means a solely automated process to evaluate or predict things about you and that is used to make a decision about you with legal or similarly significant effects).

Exercising Your Texas Privacy Rights

When you make a request under one of these rights, you can expect the following:
a. We will verify your identity. You will need to provide us with certain information such as your name, email address, phone number, property interested in, date of birth, physical address, lease address, or other information, in order for us to confirm that you are who you say you are.
b. We will respond to your request within 45 days. If necessary, we may need additional time to respond (no more than an additional 45 days), but we will reply either way within the first 45 days and, if we need an extension, we will explain why.
c. In certain cases, your request may be denied. For example, we may deny a request if we cannot verify your identity or if providing you the information could create an unreasonable risk to someone’s security (for example, we do not want very sensitive information disclosed inappropriately). If we deny your request, we will explain why we denied it. We may deny a request in part but fulfill it in part if we are able to do so, e.g., by providing you as much information as we can.
The Right to Appeal a Business or Controller’s Refusal to Take Action
If MAA denies any of your requests, or does not respond as described above, Texas residents have a right to appeal. You may make such an appeal as described in the Exercising Your Texas Privacy Rights section above. As part of our verification, we will request that you provide your Consumer Request Number, the reason or the appeal and/or other information regarding your request. In addition, you will need to provide us with certain information such as your name, email address, phone number, property interested in, date of birth, physical address, lease address, or other information in order for us to confirm that you are who you say you are.
MARKETING COMMUNICATION OPT-OUT
If you decide that you do not wish to receive marketing-related communications from MAA, you can contact us at the email or postal address provided in the Contact Us section below and indicate that you no longer want to receive marketing information relating to this Site or the Services. Please specify which types of communications you no longer wish to receive and the relevant telephone number, address, and/or e-mail address. If you do opt-out of receiving marketing-related messages from us, we may still send you administrative messages.
We will respond as required by applicable law and as otherwise deemed appropriate in our reasonable discretion under the circumstances. We do not discriminate against individuals who exercise opt-out rights. We may not be able to delete or change information that you have given us that has already been passed to one of the third parties we mentioned above.
